AGRICULTURAL PRODUCE (CEREALS) (AMENDMENT) ACT, 1936.


AN ACT TO MAKE FURTHER PROVISION FOR FIXING THE MINIMUM PRICES OF HOME-GROWN MILL-ABLE WHEAT, AND FOR THAT PURPOSE TO AMEND THE AGRICULTURAL PRODUCE (CEREALS) ACT, 1935 . [28th November, 1936.]

BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—

Definitions.

1. —In this Act—

the expression “the Act of 1935” means the Agricultural Produce (Cereals) Act, 1935 (No. 26 of 1935);

the expressions “home-grown millable wheat” and “sale (wheat) year” have the same meanings as such expressions have in the Act of 1935.

2. —(1) Where an order (in this section referred to as an original order) under sub-section (2) of section 12 of the Act of 1935 has been made (whether before or after the passing of this Act) by the Executive Council in respect of a sale (wheat) year, the Executive Council may, whenever and so often as they think fit, by order (in this section referred to as a substitutive order), which shall come into operation on the first day of the month next following the month in which such substitutive order is made, do, subject to the provisions of sub-section (2) of this section, the following things that is to say:—

(a) divide, by reference to bushel weights, home-grown millable wheat, the bushel weight of which is not less than the bushel weight declared by such substitutive order to be the minimum bushel weight for the purposes of classification, into such and so many classes as they think fit;

(b) fix in respect of wheat of each such class and in respect of each month, commencing after the date on which each substitutive order is made, in such sale (wheat) year, the price, in terms of a rate per barrel, of wheat of that class for that month;

and whenever any substitutive order is made in respect of a sale (wheat) year, such substitutive order shall, subject to the provisions of this section, have the like effect as if it were the original order in respect of such sale (wheat) year.

(2) Wherever and so often as a substitutive order (in this sub-section referred to as the new order) is made in respect of a sale (wheat) year, the following provisions shall have effect, that is to say:—

(a) in case no previous substitutive order has been made in respect of such sale (wheat) year, the new order shall include all wheat included in any class constituted by the original order in respect of such sale (wheat) year, and shall fix, in respect of such wheat and in respect of each month to which the new order applies, a price not less than the price fixed in respect of such month by such original order for wheat of the same bushel weight;

(b) in case any previous substitutive order or orders have been made in respect of such sale (wheat) year, the new order shall include all wheat included in any class constituted by such previous substitutive order or, where two or more such previous substitutive orders have been made, the last of such previous substitutive orders, and shall fix, in respect of such wheat and in respect of each month to which the new order applies, a price not less than the price fixed in respect of such month by such previous substitutive order or the last of such previous substitutive orders (as the case may be) for wheat of the same bushel weight.

(3) Whenever and so often as a substitutive order (in this sub-section referred to as the new order) is made in respect of a sale (wheat) year, then, as on and from the date on which the new order comes into operation, the following provisions shall have effect, that is to say:—

(a) in case no previous substitutive order has been made in respect of such sale (wheat) year, the original order in respect of such sale (wheat) year shall, in case the new order comes into operation on or before the first day of such sale (wheat) year, cease to have effect in respect of such sale (wheat) year or, in case the new order comes into operation on any day in such sale (wheat) year, other than the first day, cease to have effect in respect of the part then unexpired of such sale (wheat) year;

(b) in case any previous substitutive order or orders have been made in respect of such sale (wheat) year, such previous substitutive order or, where two or more such previous substitutive orders have been made, the last of such previous substitutive orders shall, in case the new order comes into operation on or before the first day of such sale (wheat) year, cease to have effect in respect of such sale (wheat) year or, in case the new order comes into operation on any day in such sale (wheat) year, other than the first day, cease to have effect in respect of the part then unexpired of such sale (wheat) year.

(4) Every substitutive order shall be published in the Iris Oifigiúil as soon as may be after it is made.

Short title and citation.

3. —(1) This Act may be cited as the Agricultural Produce (Cereals) (Amendment) Act, 1936.

(2) For the purpose of collective citation the expression “the Agricultural Produce (Cereals) Acts, 1933 to 1936” shall include this Act.
