FISHERIES (REVISION OF LOANS) ACT, 1931.


AN ACT TO MAKE PROVISION FOR THE REMISSION OR REDUCTION OF THE AMOUNTS REPAYABLE IN RESPECT OF CERTAIN LOANS MADE OUT OF PUBLIC MONEYS FOR PURPOSES RELATING TO SEA FISHING AND TO MAKE PROVISION FOR THE WRITING OFF OF IRRECOVERABLE BALANCES OF OTHER SUCH LOANS. [31st July, 1931.]

BE IT ENACTED BY THE OIREACHTAS OF SAORSTÁT EIREANN AS FOLLOWS:—

Definitions.

1. —In this Act—

the expression “the Minister” means the Minister for Lands and Fisheries;

the word “loan” means a loan either made, before the passing of this Act, by the Department of Agriculture and Technical Instruction for Ireland, the Congested Districts Board for Ireland, or the Minister for Fisheries for the provision of sea fishing boats, the provision of equipment for sea fishing boats, the provision of sea fishing gear, or any other purpose relating to sea fishing, or made, whether before or after the passing of this Act, by the Minister for any such purpose.

Remission or reduction of loans.

2. —(1) The Minister may, with the consent of the Minister for Finance, remit all or any part of the balance outstanding at the passing of this Act on foot of any loan made before the passing of this Act.

(2) The Minister may, with the consent of the Minister for Finance, make any remission authorised by this section either unconditionally or subject to the performance by any person liable (whether as borrower, surety, or otherwise) for the balance the subject of such remission of such conditions as the Minister, with the consent aforesaid, shall think proper to impose and, in particular, conditions as to the making of a payment on foot of such balance within a specified time and the transfer to the Minister or any other person of any fishing boat, equipment, or gear.

Saving for liability of sureties.

3. —The remission by the Minister under this Act of part of the amount which is outstanding at the passing of this Act on foot of a loan shall not operate to relieve from liability for the residue of such amount any person who is liable as surety for the repayment of such loan.

Writing off of irrecoverable balances.

4. —The Minister for Finance, on being satisfied that the balance for the time being outstanding and unpaid of any loan (whether made before or after the passing of this Act) is irrecoverable, may authorise the Minister to write off such balance as an irrecoverable debt, and thereupon the Minister shall write off such balance accordingly.

Laying of statements before the Oireachtas.

5. —(1) The Minister shall lay before each House of the Oireachtas, at such times and from time to time as the Minister for Finance shall direct, statements showing the sums remitted or written off under this Act in respect of loans since (as the case may require) the passing of this Act or the next previous such statement.

(2) Every statement laid before the Houses of the Oireachtas under this section shall be in such form and contain such particulars as the Minister for Finance shall direct.

Short title.

6. —This Act may be cited as the Fisheries (Revision of Loans) Act, 1931.
